According to the latest legal developments in Thailand, condominiums which also operate as hotels, commonly known as condotels, are not permitted in Thailand. A circular letter issued by Thailand’s Land Department on 6 November 2023 made it clear that although Thailand’s Condominium Act allows some units within a condominium to be used for commercial purposes to service residents, like restaurants, permitted commercial purposes do not include hotel operations. Therefore, irrespective of co-owner consents, condominiums cannot be used as hotels in Thailand.
